1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the website www.casestudi.es and all related products and services (collectively, the “Services”) provided by Casestudies, Inc. (“Casestudies,” “we,” “our,” or “us”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
2. Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you have the full right, power, and authority to enter into these Terms and perform your obligations under them.
3. Accounts
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or security breach.
4. Subscriptions and Payments
Casestudies, Inc. offers subscription-based Services for business customers.
- Payments: All payments are processed securely by third-party processors (e.g., Stripe). We do not store full credit card information.
- Renewals: Subscriptions automatically renew unless canceled in accordance with your plan terms.
- Cancellations: You may cancel your subscription at any time, but fees already paid are nonrefundable except where required by law.
- Taxes: You are responsible for any applicable taxes related to your purchase.
5. User-Generated Content and Rights
Our platform allows users to create, upload, or otherwise submit videos, testimonials, images, case studies, and other materials (“User Content”).
a. Ownership and License.
You retain ownership of your User Content. However, by submitting or publishing User Content through the Services, you grant:
- Casestudies, Inc. a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to host, store, display, reproduce, modify, distribute, and otherwise use your User Content in connection with operating, improving, and promoting the Services.
- Our Customers (the companies or organizations who invited you to participate) a separate, worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, edit, publish, display, and distribute your User Content for their own marketing, promotional, or internal business purposes — including but not limited to use on websites, social media, paid advertising, internal communications, and sales materials.
b. Rights Release.
By submitting or publishing User Content, you acknowledge and agree that:
- Your name, likeness, voice, or other personal identifiers may appear in connection with your User Content.
- You grant Casestudies, Inc. and its Customers full permission to use your User Content in perpetuity for commercial and non-commercial purposes.
- You release Casestudies, Inc. and its Customers from any claims relating to the use, distribution, reproduction, or public display of your User Content, including for commercial or promotional purposes.
- You understand that once User Content is published, it may be publicly accessible and may not be fully removable.
c. Responsibility for Content.
You are solely responsible for your User Content and for ensuring that you have all necessary rights, permissions, and consents to submit it. You represent and warrant that your User Content does not infringe, misappropriate, or violate any third-party rights or applicable laws.
d. Moderation and Removal.
Casestudies, Inc. reserves the right, but not the obligation, to remove or disable access to any User Content that we believe violates these Terms or is otherwise inappropriate or harmful.
6. Intellectual Property
All intellectual property in the Services, including but not limited to the platform, designs, trademarks, software, and all associated content, is owned or licensed by Casestudies. You may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our prior written consent.
You may use our platform only for lawful business purposes and in accordance with these Terms.
7. Acceptable Use
You agree not to:
- Use the Services for any unlawful or unauthorized purpose.
- Upload viruses, malware, or malicious code.
- Attempt to gain unauthorized access to our systems.
- Interfere with or disrupt the Services or other users’ experiences.
- Use the Services in a way that infringes upon the rights of others.
We reserve the right to investigate and take action, including termination of accounts, for any violations of this section.
8. Termination
We may suspend or terminate your access to the Services at any time, without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful to our interests or other users.
Upon termination, the rights and licenses granted to Casestudies, Inc. and its Customers under Section 5 (User-Generated Content and Rights) will continue in full force and effect.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Casestudies, Inc. does not warrant that the Services will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Casestudies, Inc. and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Services.
Our total aggregate liability for any claim related to the Services shall not exceed the amount you paid to Casestudies, Inc. in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Casestudies, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your use or misuse of the Services;
- Your User Content;
- Your violation of these Terms or applicable law; or
- Your infringement of any third-party rights.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in San Francisco County, California, administered by the American Arbitration Association. Each party waives the right to a jury trial.
13. Changes to These Terms
We may update these Terms periodically. If we make significant changes, we will post the updated Terms on our website with a revised “Last Updated” date. Continued use of the Services after such updates constitutes your acceptance of the new Terms.
